1.3.8. What are the conditions for granting international protection?
The following examples are considered to be persecution and are grounds for granting international protection:
• physical, psychological or sexual violence;
• discriminatory law or if the law is enforced in a discriminatory manner, or if the police, other authorities or the court work in a discriminatory manner;
• if courts impose penalties that are disproportionate or discriminatory;
• if you cannot get help from the court;
• if you are persecuted or punished in your country when you refuse to perform military service during a conflict, and performing military service would involve serious crimes or serious criminal acts;
• if you are persecuted in your country because you are of a certain gender or because you are a child.
Perpetrators of persecution are persons or authorities that persecuted you in your country (for example, the police), or members of parties or organizations that control the state or a significant part of the territory, or persons and groups (for example, criminal groups or terrorist groups) that have no direct ties to the state, but the state could not protect you from their persecution.
