1.3.9. Who is not entitled to international protection?
Asylum will not be granted to you, even if you meet the conditions for granting asylum, if:
• you have protection or receive assistance from authorities or agencies of the United Nations, other than UNHCR;
• you already have an approved residence in a country, on the basis of which you have the same rights and obligations as citizens of that country,
• you are considered to have committed, encouraged or otherwise participated in a crime against peace, a war crime or a crime against humanity, a serious non-political crime outside of Croatia, before arriving in Croatia, including cruel and unusual punishment, even if they were committed with an alleged political objective, or if you have acted contrary to the objectives and principles of the United Nations.
You will not be granted subsidiary protection even if you meet the following conditions:
• if you have committed, encouraged or participated in a crime against peace, a war crime or a crime against humanity, a serious criminal offense (if a prison sentence of five years or a heavier penalty had been passed by a court of law) or acts that are contrary to the goals and principles of the United Nations;
• if you pose a threat to national security or public order in Croatia.
Your application will be rejected:
• if you have been granted international protection in another member state of the European Economic Area or in a third country whose rights you still enjoy, provided that you would be accepted again in that country;
• if it is possible to apply the institute of the safe third country;
• if it is possible to apply the institute of the European safe third country;
• if the responsibility of another member state of the European Economic Area has been established for considering your request;
• if you submitted a request and you are a citizen of an EU member state;
• if you submitted an inadmissible subsequent application.
You are not entitled to international protection if your reasons are of economic nature.
